According to Argentina’s Ole newspaper, a Brazilian court has recently ruled against former football star Robinho’s lawyer’s request to reclassify his rape conviction from a “heinous crime” to a “common crime.” Robinho was convicted of rape in Italy in 2013 and sentenced to nine years in prison. He is currently serving his sentence in a prison in São Paulo, Brazil.
Robinho’s lawyers argued that according to Brazilian law, his crime should not be classified as a “heinous crime,” which could pave the way for a reduced sentence. However, Brazilian judge Luís Santos, in his ruling, explicitly stated that rape itself constitutes a “heinous crime,” regardless of whether the perpetrator acts alone or with others.
The judge also noted that at the time of Robinho’s crime in 2013, rape was already defined as a “heinous crime” under Brazilian law, meaning this definition would still apply even though the case occurred abroad.
Robinho’s lawyers had argued in earlier applications that although the Brazilian Superior Court of Justice (STJ) had recognized the Italian conviction, classifying the crime as a “heinous crime” required more direct legal grounds. Lawyer Mario Rossi Valle explained that STJ recognition does not automatically equate to confirmation of the crime’s seriousness, as this seriousness should be based on clear legal provisions.
However, the latest ruling by the Brazilian court upholds the original classification of Robinho’s crime, indicating that Brazil remains firm in its stance on punishment for serious offenses like rape, even within an international legal framework.
Despite this, Robinho is not completely isolated in prison, and reports suggest he is participating in television repair and reading courses offered by the prison to pass his time while serving his sentence.
